JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341 and 307 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that on the order of co-accused Sakti Nath Jhaa, co-accused, Indrakant Jha, Jai Narayan Jha and this petitioner resorted to fire on the informant. It is submitted by learned counsel for the petitioner that only one fracture injury found to have been caused to the informant but it does not reflect that it was caused by firearm whereas at earlier point of time petitioner's side also lodged a case against the informant and three persons from petitioner's side received injury. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.4789 of 2015 (4) dt.13-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biraul at Benipur in connection with Ghanshyampur P.S. Case No. 191 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
