The petitioner seeks bail in a case registered under section 392 of the Indian Penal Code.
The present case was lodged against unknown for robbery of Scorpio.
Learned counsel for the petitioner submits that the petitioner is not named in the first information report and nothing has been recovered from the possession of the petitioner. The petitioner was apprehended in Banka P.S. Case No. 397 of 2013 under section 364 and other allied sections of the Indian Penal Code. In that case on Toyota Enova was recovered but even then the petitioner was remanded in the present case. The
Patna High Court Cr.Misc. No.4573 of 2015 (2) dt.04-02-2015 2/2 petitioner is in jail since 16.09.2014 but he has not been put on T.I.P. till date. It is stated that one Adhar Card of the informant of the present case was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that Adhar Card and Voter Card was recovered from the possession of Manish Kumar another co-accused.
Considering the fact that petitioner was remanded in the case but he was not put on T.I.P and no looted article was recovered from the possession of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate,. Begusarai in Begusarai Muffasil P.S. Case No. 445 of 2013.
