This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned Additional Sessions Judge 1st , Kaimur at Bhabua, in connection with SC/ST Reg. No.19 of 2018, arising out of Mahila (Bhabua) Police Station Case No.08 of 2018, registered under Section 376 of the Indian Penal Code, Section 4 of the POCSO Act and Section 3(1)(w) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Allegation against the appellant is that he ravished to the informant. The informant has already been examined during the
Patna High Court CR. APP (SJ) No.4784 of 2018 dt.06-02-2019 2/2 course of trial. Earlier this Court had refused prayer vide Annexure-1.
Considering the stage of the trial and nature of allegation, this Court is not inclined to review the earlier order. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within nine months.
Accordingly, the appeal stands dismissed.
