JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.10.2015 in a case registered for the offences punishable under Section 302 of the Indian Penal Code.
Petitioner happens to be step mother of the deceased and it is stated that she provided poisonous water to the deceased, who having consumed the aforesaid poisonous water died on the same day. The investigation against the petitioner has already been completed but so far as viscera report is concerned, the same has not been received as yet.
There is nothing on the record to show that release of the petitioner shall hamper the trial or the petitioner shall tamper with the prosecution evidence.
Patna High Court Cr.Misc. No.18063 of 2016 (2) dt.02-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Mufassil P.S. Case No. 279 of 2015.
