JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-09-2017 Heard learned counsel for the petitioner, State and counsel appearing on behalf of the opposite party no.2. Vide order dated 30.08.2017, this court has indicated that the parties may interact with their clients and revert back with latest instruction on the point whether the parties are ready to settle the dispute amicably.
Both the petitioner and the opposite party no.2 are ready to compound their case arising out of the same incident dated 25.10.2012. The dispute between the parties arising out of motorcycle accident and in the instant case both the parties have sustained injuries and the motorcycle was damaged. In such trivial matter, the dispute led to filing of two
Patna High Court Cr.Misc. No.39724 of 2014 (5) dt.15-09-2017 2/2 different FIRs namely, Nayagaon P.S. Case Nos. 52 of 2012 and 42 of 2012 respectively. In both the cases, the police after investigation has submitted charge-sheet and as such they are facing criminal case. In fact, such matters should have been compromised between the parties in stead of filing criminal case and chasing up to the High Court is uncalled for, however, good sense has prevailed between the parties and now they have agreed to settle their disputes by entering into a compromise. In such circumstances, the application is disposed of with direction to the District and Sessions Judge, Begusarai to see that both the cases arising out of Nayagaon P.S. Case Nos. 52 of 2012 and 42 of 2012 are placed before the same court in order to record compromise between the parties and if such compromise is filed within a period of three months from today in the court below, the court below is expected to record the compromise and close the case as directed hereinabove.
