The petitioner is apprehending his arrest in connection with Aurangabad (Town) P.S. Case No.401 of 2013 for allegedly having committed the offences under Sections 461 and 379 of the Indian Penal Code.
It is submitted on behalf of the petitioner that a theft was committed in the shop of Md. Salim Ahmad and an F.I.R. was registered against unknown person. However, name of the petitioner has surfaced on the confessional statement of one coaccused Sonu Kumar, who is minor and has inimical terms with the petitioner. It is further submitted that save and except the confessional statement made before the police, there is no
Patna High Court Cr.Misc. No.41193 of 2014 (3) dt.11-03-2015 2/2 cogent evidence and that the petitioner has no criminal antecedents.
Considering the aforementioned submissions, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No.401 of 2013 (Trial No.685 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
