Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 376 of the Indian Penal Code.
The present case i.e. Rail Chapra P.S. Case No. 52 of 2015 was registered on the basis of complaint petition bearing Complaint Petition No. 03 of 2015 which had been filed by the informant on 10.07.2015 and in the aforesaid complaint petition, she stated that alleged occurrence took place on 05.06.2015 but when her statement under Section 164 of the Cr.P.C. was recorded, she stated that alleged occurrence took place on 6th July. Patna High Court Cr.Misc. No.18554 of 2016 (3) dt.03-05-2016 2/2 rape on her but considering the facts and circumstances of the case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Saran at Chapra in connection with Rail Chapra P.S.
