The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 366(A)/34 of the Indian Penal Code.

As per prosecution, it is of abduction of the daughter of the informant by the petitioner along with other accused persons.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. It is submitted that the victim girl recovered and recorded her statement under Section 164 of Cr.P.C. but she has not specifically stated against the petitioner that he enticed her. It is submitted that the main accused Ajeet Sahni who taken away the victim girl because of

No.60205 of 2022(2) dt.08-02-2023 2/2 voluntarily eloped with Ajeet Sahni for the purpose of travelling and on pressure of her parents given her statement under Section 164 Cr.P.C. against Ajeet Sahni and others before the court below. Petitioner is in custody since 28.07.2022. Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bakhri P.S. Case No. 57/2022, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
