====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-02-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

The petitioner is apprehending his arrest in Wazirganj P.S. Case No. 398/14 registered under Section 307 and other sections of the Indian Penal Code.

The informant Vishun Yadav named six persons in the F.I.R. and alleged that they all demolished his boundary wall. The petitioner is alleged to have assaulted the informant Vishun Yadav with Khanti on his head.

Learned counsel for the petitioner submits that there is a case and counter-case. Some scuffle took place on account of land dispute and on account of assault made by the petitioner, the informant Vishun Yadav got one lacerated wound measuring 3" x

Patna High Court Cr.Misc. No.4362 of 2015 (2) dt.02-02-2015 2/2 1/4" x 1/8" and another lacerated wound measuring 1" x 1/8" x 1/8".

Learned counsel for the informant has submitted that the other accused persons have been granted regular bail. Having considered the facts that there is case and counter-case and the quarrel took place on account of land dispute and on account of the assault made by the petitioner, one superficial injury is alleged to have been caused on the head of the informant, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Wazirganj P.S. Case No. 398/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
