The present petition has been filed with a prayer to restore MJC No. 4349 of 2009 , which stood dismissed due to non -compliance of peremptory order dated 6.8.2014. After hearing learned counsel for the parties and considering the facts disclosed in the petition, same is allowed. Let MJC No. 4349 of 2009 be restored to its original file.

It is clarified that if the order dated 6.8.2014 passed in MJC No. 4349 of 2009 is not complied within a period of three weeks from today , MJC No. 4349 of 2009 shall stand dismissed without further reference to a Bench.
