In this case, the petitioner is seeking anticipatory bail in connection with Chiraiya P.S. Case No. 330 of 2018, registered for the offence punishable under Sections 30(a) and 37(b) of the Indian Penal Code.

As per the F.I.R. one person was coming in intoxicated condition, carrying 3000 ml. of Nepali liquor. After some time, another person was intercepted on motorcycle and from the dickey of the motorcycle 300 ml. of liquor was recovered, one person fled away, has been identified as present petitioner.

Looking to the facts and circumstances of the case as also the quantum of recovery of liquor, let the petitioner,

Patna High Court Cr.Misc. No.79040 of 2018(2) dt.09-01-2019 2/2 namely, Saheb Singh, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 7th Additional Sessions Judge -cum- Special Judge, Excise, Motihari, East Champaran, in connection with Chiraiya P.S. Case no. 330 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
