Petitioners apprehend their arrest in Alauli P.S. Case No.335 of 2018 registered under Section 307 and other minor sections of the Indian Penal Code.

In sum and substance the allegation is that the petitioners and others had come to the land of the informant and started digging his land. On protest, the petitioners and others assaulted the informant and his family members and also snatched chain, ornaments, cash from their possession. Learned counsel for the petitioners submits that from the side of the petitioners, Alauli P.S. Case No.336 of 2018 was

Patna High Court Cr.Misc. No.80160 of 2018(2) dt.16-01-2019 2/2 registered against the informant of the present case and others. Petitioner no.4, Rama Sada has alleged in his fardbeyan on which Alauli P.S. Case No.336 of 2018 was registered that Anil Yadav and others made indiscriminate firing and snatched money and other ornaments from the house of the informant and others.

Considering the facts that there appears case and counter case and the dispute took place due to land dispute and the fact that the injuries found on the persons of the informant and others are simple in nature as submitted by the counsel for the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Alauli P.S. Case No.335 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
