2. The petitioner seeks regular bail in connection with Jalalgarh P.S. Case No. 197 of 2022, registered for the offence punishable under Sections 376, 313, 506/34 of the Indian Penal Code.

3. As per prosecution, the petitioner is the brother of the main accused Md. Majuk who is said to have committed rape upon the victim.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He has no criminal antecedent and he is in custody since 06.07.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Jalalgarh P.S. Case No. 197 of 2022.
