The petitioners are apprehending their arrest in connection with complaint case no. 1338/2013 registered for the offences punishable under Sections 498A and 494 of the Indian Penal Code.

Learned counsel for the petitioner submits that though notice was issued earlier on opposite party no. 2 through the counsel appearing in the court below however, there is no representation on her part till date.

Considering the fact that there is no opposition to the present application and that the petitioners were earlier extended ad interim protection which has not been misused till date, let the

No.5816 of 2015 (7) dt.11-01-2016 2/2 petitioners, above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Saharsa in connection with Complaint Case No. 1338/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
