JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of the Arms Act. Petitioner and some others were caught from the house of one Badruddin when they had assembled to make preparation for committing dacoity. One country made loaded pistol and six live cartridges were recovered from conscious possession of the petitioner whereas other firearms were recovered from possession of other co-accused.

Learned counsel for the petitioner submits that coaccused, Md. Sattar and Badruddin, having more or less similar

Patna High Court Cr.Misc. No.24360 of 2016 (3) dt.20-06-2016 2/2 allegation, have already been granted privilege of bail and moreover, except the present case as well as Murliganj P.S. Case No. 17 of 2003, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 01 of 2016.
