The petitioners seek anticipatory bail in a case instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act.
The police has received an information that petitioners along with two friends are doing business of illegal liquor. The police has raided the house but did not find any material showing their involvement in the alleged occurrence. The police has recovered liquor 10 meters away from the house of one Kishori Paswan.
Learned counsel for the petitioners submits that there is
Patna High Court Cr.Misc. No.24674 of 2017 (3) dt.11-07-2017 no material to show that petitioners were in any manner involved in the alleged occurrence.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Sonelal Paswan and Ramashrya Prasad @ Ramashrya Paswan @ Jataila @ Ramanath Prasad @ Rameshrya Prasad, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sikrahana at Dhaka in connection with Ghorasahan P.S. Case No.45 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
