Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Rahika P.S. Case No. 136 of 2021 registered under Sections 272, 273/34 of the Indian Penal Code read with Section 30(a) of the Bihar Excise and Prohibition Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 28.09.2021, is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of 525 litres of liquor from a Tata Magic.
Patna High Court CR. MISC. No.258 of 2022(2) dt.02-03-2022 2/2 Learned counsel for the petitioner submits that the petitioner was not arrested at the spot, his name came in the self-statement of the informant based on secret information. Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent and was not arrested at the spot, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum- Special Judge, Excise Act, Madhubani in connection with Rahika P.S. Case No. 136 of 2021.
