The petitioners, namely, Raja Ram Yadav @ Raja Ram @ Mukhiya Yadav, Naresh Yadav and Pankaj Kumar apprehend their arrest in Complaint Case No.1358 of 2014 under Sections 323, 379, 427, 504/34 of the Indian Penal Code. The learned counsel for the petitioners submitted that section 379 is the only section which is non-bailable and it appears from the allegation itself that it is super addition and nothing else. Perused the complaint case. It appears that in the complaint it is said that the accused persons assaulted the

Patna High Court Cr.Misc. No.41822 of 2014 (2) dt.20-03-2015 complainant when the complainant stopped the cattle from entering in his paddy field and the petitioners snatched Rs.5,000/- from the pocket of the complainant.

In view of the nature of the allegation I direct the petitioners to surrender before the court below within one month from today and on their so surrendering the petitioners shall be released on bail on furnishing bail bonds of Rs.5,000/-(rupees five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Complaint Case No.1358 of 2014.
