Petitioner apprehends arrest in connection with Barbigha P.S. Case No. 541 of 2022 registered for the offence under sections 458, 341, 342, 323, 436, 429/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Moreover, similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 23.08.2023 passed in Cr. Misc. No. 52603 of 2023 as contained in Annexure-3. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.63372 of 2023(2) dt.16-10-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 541 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
