1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 366(A)/ 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 08.07.2024 and had earlier moved before this Court seeking anticipatory bail by filing Cr. Misc. No.18297 of 2024 and the same was rejected by an order dated 02.04.2024 on the ground that the victim though had not supported the case of the prosecution in her statement recorded under Section 164 of the Cr.P.C. and had stated that he had married the petitioner, but then, she was a minor on the date of occurrence aged about 16

4. The learned counsel for the petitioner submits that no useful purpose would be served by keeping the petitioner in jail when the victim has not supported the case of the prosecution, whether victim was a major or a minor on the date of occurrence would be seen in the trial.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Sonepur P. S. Case No.487 of 2023.

7. The application stands allowed.
