This application, for grant of anticipatory bail, arises out of Kuchaikot Police Station, Case No. 169 of 2016, disclosing offences under Sections 498(A), 406 of the I.P.C. and 3⁄4 of Dowry Prohibition Act.
It is a case of the prosecution that the petitioner no.1 is mother-in-law and petitioner nos. 2 and 3 are brothers-in-laws of the husband of the informant. The appeal filed by the informant is on the basis of the registration of the F.I.R. Learned counsel appearing on behalf of the petitioners has submitted that it is evident from records that lodging of F.I.R.
Patna High Court Cr.Misc. No.27232 of 2017 (2) dt.01-07-2017 2/2 is the result of matrimonial dispute between the husband of the informant and the informant.
Considering the submission, as above, this application is allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Kuchaikot P.S. Case No. 169 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
