JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-04-2022 Heard Mr. Pramod Kumar Singh, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Samastipur Town P.S. Case No. 18 of 2020 dated 18.01.2020 instituted for the offences under Sections 406, 409, 420 and 34 of the Indian Penal Code.

On 17.02.2022, this Court had passed the following order and had called for the case diary:

"The In-charge Branch Manager of Samastipur District Central Cooperative Bank (in short 'Bank'.) has lodged a case alleging that in the year 2005, huge amount of money was defalcated. At the relevant time, the petitioner was one of the collecting agents against whose name Rs. 14,72,000/-

It has been submitted on behalf of the petitioner that he had deposited Rs. 68,48,876/- in the Bank for which the deposit challan is with him. He further submits that there has not been any proper accounting and the Bank has not provided him the documents demanded by him on the basis of which, he could demonstrate that no amount is due to him.

The brother of the petitioner has also filed an application under the Right to Information Act seeking certain documents like the concerned ledger from the Branch Manager which has uptil now not been responded.

Under similar circumstances, it has been urged, one of the accused persons of this case has been granted anticipatory bail by order dated 10.02.2021 passed in Cr. Misc. No. 15391 of 2021."

The case diary has since been received.

Nothing otherwise has been reported in the police papers.

Considering the afore-noted facts, the provisional bail granted to the petitioner by order dated 17.02.2022 is, hereby, confirmed.

The petitioner shall remain on the same bail bonds.
