The petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 251 of 2016, registered for the offences punishable under Sections 419, 420, 464, 468, 471, 406 of the Indian Penal Code.

Allegedly, the petitioner took loan of Rs. 9,50,000/- from the informant with undertaking to return the same in four months and when the money was demanded, the petitioner gave cheque of Rs. 9,50,000/- but the same was dishonoured as the signature of the petitioner was not same, again the informant demanded the cash then again he gave cheque but the same was

Patna High Court Cr.Misc. No.14386 of 2017 (3) dt.29-06-2017 2/3 also dishonoured and further caused threats and the petitioner snatched gold chain of 20 grams.

Submission is of false implication and that the petitioner has lodged Kankarbagh P.S. Case No. 380 of 2016 on 16.06.2016 itself wherein the informant of this case is also an accused. The cheque was snatched from the petitioner and that cheque was used after making signature. Informant and anothers want to grab the gym of the petitioner. F.I,R. of Kankarbagh P.S. Case No. 380 of 2016 is attached as Annexure-2 to this bail application. During investigation also the statement of the informant has not been found true and a report has been called for from the Income Tax Department. It is not probable and reliable that the informant paid Rs. 9,50,000/- in cash to the petitioner and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, considering that the case lodged by the petitioner is of earlier and as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each
