2. The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 472 of 2021 registered on 12.11.2021 lodged under Sections 20(b)(ii), 23, 27(a), 29 of the NDPS Act.

3. As per the prosecution case, F.I.R. has been lodged against three named accused persons including the petitioner from whose possession total of 4.010 gm if charas has been recovered.

4. Counsel for the petitioner submits that from the possession of the petitioner 1.030 gms of charas has been recovered.

5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner

6. Learned counsel for the State opposes the prayer for bail and submits that the said recovery is more than commercial quantity. He further submits that on the early occasion, this Court has called for the progress report of the trial.

7. From the progress report, it seems that trial is likely to be concluded within short period of six months.

8. In the present facts and circumstances of this case, I am not inclined to grant bail to the petitioner at present. Accordingly, the bail application of the petitioner stands rejected.
