SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with Complaint Case No. 625 of 2014 registered for the offence under Section 420 of the Penal Code.

It is submitted on behalf of the petitioner that he shall deposit 1/3rd of the cheated amount of Rs. 4,31,000/- in the court below within one month from the date of receipt/production of a copy of this order in the court below, whereafter petitioner be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Sri S.P. Morya, Judicial Magistrate 1st Class, Banka in connection with Complaint Case No. 625 of 2014 subject to the conditions as laid down under Section 438(2)

Patna High Court Cr.Misc. No.9802 of 2015 (4) dt.22-05-2015 2/2 of the Cr.P.C. The deposited amount shall be handed over to the complainant, shall be subject to the result of the trial. In the event, petitioner succeeds in the trial, he shall get back the deposited amount from the complainant with 8 per cent interest within one month of the judgment, otherwise the complainant may be liable for contempt of the order of the Court.
