JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 31-08-2018 The grievance of the petitioner is non-payment of honorarium for the period the petitioner has worked as Tola Sevak. From the pleadings, it appears that the petitioner was restrained from working as Tola Sevak on the ground of a dispute as to caste certificate.

This writ petition was filed on 08.10.2014. It was listed for the first time on 05.12.2017 but no one had appeared on behalf of the petitioner. No one had appeared on behalf of the petitioner when the case was earlier listed before this Court also and under the compelling circumstances, the case has been listed under the heading "For Dismissal" today in order to provide one more opportunity to the counsel for the petitioner to assist the

Under the aforesaid circumstances, the writ petition is disposed of with a direction to the concerned respondent to examine whether the petitioner has been paid honorarium for the period he has actually worked. So far as the other grievance as to restraining the petitioner from working as Tola Sevak is concerned, liberty shall be available to the petitioner to raise the issue before the concerned authority, who shall look into the grievance of the petitioner and decide the same objectively, if not already decided, within a maximum period of four months from the date of receipt/production of a copy of this order.
