Learned counsel for the petitioner has pointed out that the matter was taken up on Wednesday but in the first paragraph, it has been inscribed as follows : " Heard learned counsel for the petitioner and learned APP for the State in Virtual Court Proceeding."
It is his further submission that while declining the anticipatory bail application, this Court had also given observations on the circumstances, if the petitioner chooses to surrender, which is also missing.
Accepting the words of the learned counsel for the
Patna High Court CR. MISC. No.72362 of 2022(4) dt.14-02-2023 2/2 petitioner as also the fact that there is anomaly in paragraph-1 of the petition, the same is modified to the following extent. The first paragraph be read as follows:
"(i) Heard learned counsel for the petitioner and learned APP for the State."
Similarly the concluding paragraph be read as follows:
"If the petitioner surrenders within a period of four weeks from today, the concerned Court shall take into account the factors available on record without being prejudiced by any observations made herein and pass an appropriate order, preferably on the same day."
