Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 447, 114, 341, 323, 379, 325, 147, 148, 149, 324, 307, 354(B) and 34 of Indian Penal Code, registered in connection with Triveniganj P.S. Case No. 249 of 2020.

As per allegation, the petitioner along with other coaccused persons brutally assaulted the members of the informant. Co-accused, namely, Ravi Yadav assaulted with

Patna High Court CR. MISC. No.270 of 2022(2) dt.30-05-2022 2/3 Farsa on the head of father-in-law of the informant and the allegation the petitioner is that he assaulted her father-in-law with Garhel in his both legs.

The learned counsel for the petitioner has submitted that though there is some injuries sustained by the members of informant and injury sustained on the head of father-in-law, but the same are not attributed against the present petitioner. He further submits that for the same day occurrence, there is also a counter case in which members of petitioner's side has sustained injuries.

Considering the above facts and circumstances as well as period of custody i.e. 17.07.2021, let the petitioner abovenamed be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-V, Civil Court, Supaul, in connection with Triveniganj P.S. Case No. 249 of 2020, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make him available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
