ANJANA MISHRA ORAL ORDER 09-07-2015 Since both the criminal miscellaneous applications arise out of the same police station case, they have been heard together and are being disposed of by this common order. Heard learned counsel for the petitioners and the learned counsel for the State.
Patna High Court Cr.Misc. No.11473 of 2015 (3) dt.09-07-2015 2/3 The petitioners in Cr.Misc. No.11473 of 2015 and Cr.Misc. No.19094 of 2015 are apprehending their arrest in connection with Purnahiya P.S. Case No.84 of 2014 for allegedly having committed the offences under Sections 147, 148, 149, 324, 326 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Case diary in the present case has been received. Learned counsel for the petitioners submits that the allegation against the petitioners is general and omnibus and no case is made out.
Learned counsel for the State submits that excepting the role of petitioner No.1 Rajkishor Singh in Cr.Misc. No.11473 of 2015, other two petitioners have been clearly referred to as having participated in the occurrence and there are enough materials against them in the case diary so as to connect them with the present case.
Considering the aforementioned submissions and the fact that no specific role has been assigned to petitioner No.1 Rajkishor Singh in Cr.Misc. No.11473 of 2015, let Rajkishor Singh, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on
Patna High Court Cr.Misc. No.11473 of 2015 (3) dt.09-07-2015 3/3 furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Subash Chandra, Judicial Magistrate, 1st, Sheohar, in connection with Purnahiya P.S. Case No.84 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
So far as petitioner No.2 Sushil Singh @ Sushil Kumar Singh in Cr.Misc. No.11473 of 2015 and sole petitioner Raj Kumar Singh in Cr.Misc. No.19094 of 2015 are concerned, I am not inclined to grant anticipatory bail to them. The respective miscellaneous applications on their behalf are, accordingly, dismissed.
