2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 25(1-b)(a) and 26 of the Arms Act.
3. The case of the prosecution is that from the possession of the petitioner one loaded country made pistol was recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been falsely implicated in this case. He has nothing to do with the seized pistol. The petitioner is in custody since 24.04.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.77379 of 2024(3) dt.18-01-2025 2/2 considering the facts and circumstances of the case as well as the period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of CJM, Buxar in connection with Buxar (M) P.S. Case No. 135 of 2024.
7. Accordingly, the present bail application stands allowed.
