JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

Allegation in brief is that three candidates in the name of Bindu Kumari but having husband's name varying are appointed in three schools of different Panchayats but using the same educational certificate and the petitioner is the Mukhiya of one of the Gram Panchayat and it is alleged that the original certificate was not properly verified by the petitioner. Learned counsel appearing on behalf of the petitioner submits that as per the notification dated 22.6.2012 with regard to the employment of Primary Teachers the responsibility of

Patna High Court Cr.Misc. No.29067 of 2017 (2) dt.01-07-2017 2/2 verification of certificates filed by the selected candidates is of Block Education Officer and not of Mukhiya and Block Education Officer is not made accused in this case.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Manju Kumari be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No.204 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
