Petitioner seeks bail in Basopatti P.S.Case No.101 of 2018 registered for the offences under Sections 392 of the Indian Penal Code.
The informant has in his written complaint alleged that in the night of 10.5.2018 while he was going to Yasho on motor cycle along with his brother three unknown miscreants snatched his motorcycle and other costly articles and fled away. It is further alleged that he can identify the miscreants. It has been submitted on behalf of the learned counsel appearing for the petitioner that he is innocent and has been falsely implicated in this case and neither he has been apprehended on the spot nor any looted article has been recovered from the possession of the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-5th, Madhubani, in Basopatti P.S. Case No.101 of 2018 subject to the conditions that (I) bailors should be of local having sufficient immovable property lying within the jurisdiction of the court concerned. (ii) petitioner/s shall cooperate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioner tampers with the evidence or the witnesses of the case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
