JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Learned counsel for the petitioners submits that petitioner no. 1 has already been arrested and his application has become infructous.
Heard learned counsel for the petitioner nos. 2 & 3 and the State.
The petitioner nos. 2 and 3 are apprehending their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 354, 504/34 of the Indian Penal Code and 3(1) (x) (xi) of the S.C./S.T.(Prevention of Atrocities) Act.
It is alleged that the husband of the informant was working as a labour in the house of petitioner no. 1 and when he demanded wages, accused persons
Patna High Court Cr.Misc. No.10730 of 2015 (2) dt.17-03-2015 assaulted the informant's husband and abused by calling caste name.
It is submitted by the learned counsel for the petitioners that admittedly the informant's husband, if at all worked as labour, in the house of petitioner no. 1 Baliram Yadav, the petitioner no. 1 Baliram Yadav lodged a case against the informant's husband at the earlier point of time. Statement has been made in para-3 of the petition that petitioner nos. 2 and 3 have no criminal antecedent. Considering the aforesaid facts, let the above named petitioner nos. 2 and 3 be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 386 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
