The petitioner apprehends his arrest in Bibhutipur P.S. Case No. 05 of 2017 registered for the offences punishable under Sections 147, 148, 341, 323, 325, 379, 307, 354, 504 and 506 of the Indian Penal Code.
The informant alleged that on account of land dispute on the order of Nirsi Devi, the petitioner alleged to have assaulted the husband of the informant with Khanti on the head. Learned counsel for the petitioner submits that the FIR was lodged after one week of the occurrence. The petitioner filed complaint case but, it appears from the perusal of the case diary and the injury report that assault made by the petitioner caused grievous injury on the head of Yogendra Sahni.
