BAJANTHRI) 25-01-2024 The present M.J.C - Contempt petition is filed for non-compliance of the order dated 24.08.2021 passed in C.W.J.C No. 14318 of 2021 read with the petitioner's representation dated 11.09.2021. It is learnt that orders of this Court read with petitioner's

Patna High Court MJC No.2255 of 2021(4) dt.25-01-2024 2/3 representation has been complied on 19.07.2022. However, the same was not made known to this Court or to the petitioner till 19.01.2024. The reasons are not forthcoming from the show-cause, therefore, we have asked the concerned Block Development Officer, Kudhani, Muzaffarpur.

2. Today, learned counsel for the StateRespondent furnished original dispatch register, we have perused the dispatch register column against the date 19.07.2022. Even though, it has been recorded in respect of compliance order dated 19.07.2022. However, the same was not dispatched to the petitioner or communicated to the petitioner. Even after lapse of about one year and three months, the concerned B.D.O has not apprised this Court during pendency of the present M.J.C No. 2255 of 2021. In other words, there is a negligence on the part of the office of the B.D.O. In respect of compliance of the order, that too, in the contempt matter. Therefore, we proposed to impose a cost, and it is quantified at Rs. 5,000/- (Five Thousand)

Patna High Court MJC No.2255 of 2021(4) dt.25-01-2024 3/3 cost shall be paid to the petitioner within a period of eight weeks from the date of receipt of this order.

3. Accordingly, the present M.J.C stands dropped.
