The application for anticipatory bail arises out of Phulparas P.S. Case No. 133 of 2018, corresponding to G.R. No. 893 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code, including Section 27 of the Arms Act.

Considering the criminal antecedent of the petitioner, as stated in paragraph 3 of the application, I am not inclined to grant the petitioner the privilege of anticipatory bail. The application is accoringly rejected.

However, the petitioner is directed to surrender in the court below within four weeks from today and seek regular bail, if so advised. If he does so, the court below shall consider his

Patna High Court Cr.Misc. No.778 of 2019(2) dt.25-01-2019 2/2 prayer for regular bail on its own merit, without being prejudiced by the rejection of the present anticipatory bail application.
