The petitioner seeks bail in a case registered under Sections 399, 402, 414, 120B of the Indian Penal Code and 25(1-b)a/26(ii)/35 of the Arms Act.

Allegation is that one country made pistol along with one live cartridges is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.04.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with one live cartridges is alleged to have been recovered. The petitioner has remained in custody for about one year. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. case No.50 of 2018.
