Petitioner apprehends his arrest in Itarhi P.S. Case No.240 of 2018 registered under Sections 341, 323, 498(A) and 504/34 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. On account of some misunderstanding the brother-in-law of the petitioner lodged this case.

The informant-wife also submits that the wife is ready to live with her husbnd.

Considering the facts aforesaid, petitioner is directed to surrender in the court below within four weeks from the date of receipt of this order and on such the learned court below shall

No.80079 of 2018(2) dt.11-01-2019 2/2 enlarge the petitioner on provisional bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IInd, Buxar in connection with Itarhi P.S. Case No.240 of 2018. Thereafter the learned court below shall make all efforts for resolution of the dispute between the husband and wife and if the petitioner is ready to keep his wife, the learned court below shall confirm the provisional bail of the petitioner. If the petitioner is found reluctant to keep his wife and the dispute is not resolved, the learned court below shall pass order in accordance with law on the provisional bail of the petitioner after six months.
