This application, for grant of anticipatory bail, arises out of Sonebarsa Police Station Case No. 20 of 2017, disclosing offences under Sections 363, 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioners and no specific overt act is attributed to them. In fact, there was love affair between the son of petitioner No.1 and the victim and the victim out of her sweet will has chosen to perform marriage with son of petitioner No.1. In this regard they have also sworn an affidavit, which is evident from Annexure-3.
Patna High Court Cr.Misc. No.26579 of 2017 (2) dt.08-06-2017 Moreover, victim and the son of petitioner No.1 are said to be major, which is evident from Annexure-2. These petitioners have no concern with the alleged occurrence. Hence, the petitioners deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4, Sitamarhi, in connection with Sonebarsa Police Station Case No. 20 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
