The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 380, 498A, 504 and 506 of the Indian Penal Code.

The basic accusation is of torture.

On joint prayer of the parties the matter was referred to the Mediation Centre of the State Legal Services Authority but the report of the Mediator dated 11.05.2015

Patna High Court Cr.Misc. No.12129 of 2015 (6) dt.24-11-2015 2/2 reflects that the issue could not be reconciled. The matter was adjourned since last two occasions the petitioner is not appearing. Today none is appearing on behalf of the petitioner. However, the complainant along with her lawyer are present. The complainant is ready to resume the conjugal life.

In the circumstances, this application is disposed of with liberty to the learned court below to consider the prayer for regular bail of the petitioner, if the petitioner is ready to resolve the issue and surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 16C of 2014 pending in the court of learned SDJM, Sheikhpura.
