The petitioners apprehend their arrest in Complaint Case No. 183(C)/2017, registered for the offences punishable under Sections 147, 323, 452 and 504 of the Indian Penal Code. The complainant alleged that petitioners and others having armed with different weapons came inside the house of the informant and assaulted the informant and her pregnant daughter-in-law. The accused persons were asking the complainant to work in his field and on refusal, the occurrence took place.
Learned counsel for the petitioners submits that prior to institution of this case Maner P.S. Case No. 45/2017 has been
Patna High Court Cr.Misc. No.80008 of 2018(2) dt.11-01-2019 2/2 lodged by Prem Kumar Singh one of the co-accused against Mitthu Ram and Birju Ram the sons of the complainant. In order to create defense, this complaint is filed making false and frivolous allegation.
Considering the facts aforesaid and nature of allegation, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Danapur, Patna in connection with Complaint Case No. 183(C)/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
