JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Ramkrishnanagar (R.K. Nagar) P.S. Case no. 106 of 2016, registered under Sections 363 and 365 of the Indian Penal Code. The accusation is that daughter of the informant, aged about 19 years, had gone to the shop to her house, but she did not return. Thereafter, informant Sunil Kumar Singh gave information on 16.05.2016 to the Police Station regarding missing of his daughter. In course of search, informant came to know from his relative that earlier daughter of the informant used to talk on two mobile bearing Nos. 9899475139 and 7461945399. On verification, the holder of both mobile disclosed as Rahul and some other name. Learned counsel for the petitioner submits that in course of investigation first mobile number was found in the name of

No.27265 of 2017 (5) dt.21-12-2017 2/2 petitioner, who used to reside along with her husband Pankaj Chaudhary at Delhi and the second mobile was found in the name of Chandan as detailed in paragraph No. 86 of the case diary and on that mobile informant used to talk about 60 times in between 01.04.2016 to 23.05.2016 and informant also gave her statement in presence of her daughter as detailed in paragraph No. 82 in which he stated about performing the marriage of his daughter with Gautam, brother of the Chandan. Further submission is that petitioner, who is lady, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Ramkrishnanagar ( R.K. Nagar) P.S. Case No. 106 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
