1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 406, 506 and 34 of the Indian Penal Code.
3. The S.H.O., Bypass P.S. and the Investigating Officer of the case, in compliance of the order dated 23.09.2025, are present in the Court.
4. On query of the Court, the S.H.O. submits that no doubt the case is of the year 2014 but then the investigation in the case is still continuing and process under Sections 82 and 83 Cr.P.C. till date has not been sought.
5. Since the police for the last 11 years did not arrest the accused nor sought process under Sections 82/83 Cr.P.C., as
Patna High Court CR. MISC. No.63975 of 2025(3) dt.24-09-2025 2/2 such it appears that no useful purpose would be served by sending the petitioner to jail at this stage.
6. Accordingly, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bypass P.S. Case No.138/2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. The personal appearance of the S.H.O., Bypass P.S. and the Investigating Officer of the case is dispensed with. (Satyavrat Verma, J) amit/- U T
