JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-06-2017 The learned counsel for the petitioner submits that the petitioner and other accused have been allowed police bail during investigation and, as such, this criminal miscellaneous is not maintainable.
In view of the situation that the petitioner has been allowed police bail, he may be directed to surrender in the learned court below and in that case petitioner should be allowed bail as he has not misused the privilege of police bail.
Under the circumstances, the petitioner is directed to surrender in the learned court below and in that case the learned court below shall consider the matter that the petitioner has not misused the privilege of police bail and accordingly shall consider his bail petition. In the result, this criminal miscellaneous is hereby disposed of.
