The petitioner seeks bail in a case under Sections 328, 302/34 of the Indian Penal Code.

The brother of the deceased made allegation that his brother had gone to bring his wife Pratima Devi but father-in-law, brother-in-law, mother-in-law and wife of the deceased poisoned the brother of the informant to death. It is submitted that father-inlaw Sukhram Mukhiya has already been enlarged on bail vide order passed in Cr. Misc. No. 40992/2014. The petitioner is the brother-in-law of the deceased. There is no eye witness of the occurrence. The case of the petitioner stands on the same footing as that of Sukhram Mukhiya.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond
