This application, for grant of anticipatory bail, arises out of Trial No. 3651 of 2015 and Trial No. 3497 of 2016 arising out of Complaint Case No. 438 of 2015, disclosing offences under Sections 498A and 328 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the parties have settled their dispute by way of mediation before the Mediator vide Mediation Proceeding No. 291 of 2017, which is evident from the mediator's report at flag-A. Hence, the petitioner deserves the privilege of anticipatory bail.

No.51163 of 2016 (7) dt.07-07-2017 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Trial No. 3651 of 2015 and Trial No. 3497 of 2016 arising out of Complaint Case No. 438 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
