JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Chowk P.S. Case No.136 of 2016, registered under Section 366(A) of the Indian Penal Code.

Allegation in brief is that petitioner has enticed away the minor daughter of the informant.

Learned counsel for the petitioner submits that the allegation is false and fabricated, the girl was recovered but there is no allegation of any overt act against the petitioner. The fact is that the informant used to pressurize the petitioner to marry her daughter.

Learned APP submits that statement of the victim after her recovery was recorded under Section 164 Cr.P.C.

Patna High Court Cr.Misc. No.20450 of 2017 (2) dt.12-06-2017 2 / 2 wherein she has stated that she was forcibly taken away by this petitioner and her age was assessed as 16 years. Having considered the said facts and circumstances, it is not a fit case for grant of anticipatory bail. Accordingly, the prayer for anticipatory bail on behalf of the petitioner is rejected in connection with Chowk P.S. Case No.136 of 2016. (Arun Kumar, J.) S.Kumar/- U T
