Petitioner seeks bail in Baghaila P.S. Case No. 60 of 2018 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
Allegation against the petitioner is to have killed the daughter of the informant along with other F.I.R. named persons by setting her ablaze for non-fulfillment of demand of dowry.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 27.08.2018.
Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the
Patna High Court Cr.Misc. No.79622 of 2018(3) dt.25-02-2019 2/2 petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
However, the court below is directed to expedite the trial and conclude the same within one year from the date of receipt of the order and if trial is not concluded within said period petitioner may renew his prayer for grant of bail. (S. Kumar, J) Sanjay/- U T
