The petitioner seeks bail in a case registered under Sections 414, 420, 467, 468, 471/34 of the Indian Penal Code and 25(1-b)a, 26, 35 of the Arms Act.

Allegation is that one country made pistol with live cartridge, one motorcycle and one mobile are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol with live cartridge and one motorcycle are said to have been recovered

Patna High Court CR. MISC. No.59913 of 2019(2) dt.24-09-2019 2/2 from co-accused Kundan Kumar. So far the petitioner is concerned, no arms is alleged to have been recovered. No incriminating article is said to have been recovered from the petitioner. The mobile in question belongs to the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. case No.460 of 2019.
