JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Madhuban P.S. Case No. 168 of 2015, registered under Sections 147, 149, 341 and 302 of the Indian Penal Code, pending in the court of 4th Additional Chief Judicial Magistrate, Motihari, East Champaran.

The prayer for bail of the petitioners was earlier rejected twice on merit vide orders dated 20.08.2016 and 07.12.2016 passed in Cr. Misc. Nos. 33305 of 2016 and 48194 of 2016 by this Court.

No.20693 of 2017 (2) dt.21-06-2017 Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
